Welcome to KidSync. By downloading, installing, or using our mobile application, you agree to be bound by these Terms of Service ("Terms"). These Terms of Service constitute the Terms of Use for KidSync. Please read them carefully.

1. Acceptance of Terms

By accessing or using KidSync, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the app. You must be at least 18 years of age to create an account.

3. Subscriptions & Payments

KidSync offers a 14-day free trial for new families. After the trial period ends, a paid subscription is required to continue using the app.

A single subscription covers all members of a family on KidSync. Either parent or guardian on the account may purchase a subscription on behalf of the family.

Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.

You may manage or cancel your subscription at any time in your device's Settings > Apple ID > Subscriptions. Any unused portion of the free trial period will be forfeited upon purchase of a subscription.

Prices are in U.S. dollars and may vary by region based on App Store pricing. Prices are subject to change; any price increase will take effect at the start of the next billing cycle following notice to you.

Subscriptions are billed and managed by Apple. Refunds are handled in accordance with Apple's App Store policies.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating your account and to update it as necessary.

You retain ownership of all data you enter into KidSync (events, tasks, child information, messages, etc.). By using the app, you grant us a limited license to store, process, and display this data solely for the purpose of providing the service to you.

Messages sent through the in-app messaging feature are visible to all members of your family on KidSync. You are responsible for the content of your messages.

When you share a briefing or caregiver link, you are responsible for the information included and who you share it with.

7. AI-Powered Features

KidSync offers optional AI-powered conflict resolution suggestions through Google Gemini AI. These suggestions are informational only and should not be relied upon as the sole basis for important decisions. We are not responsible for the accuracy or suitability of AI-generated content.

AI features are subject to rate limits and availability. We reserve the right to modify or discontinue AI features at any time.

8. Third-Party Services

KidSync integrates with third-party services including Google Firebase, Google Sign-In, Google Gemini AI, and RevenueCat (subscription management). Your use of these services is subject to their respective terms and policies. We are not responsible for the availability or performance of third-party services.

9. Intellectual Property

The KidSync app, including its design, code, branding, and content, is owned by KidSync and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the app without our written consent.

10. Disclaimer of Warranties

KidSync is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the app will be uninterrupted, error-free, or completely secure. We are not responsible for any scheduling errors, missed events, or other consequences arising from use of the app.

11. Limitation of Liability

To the maximum extent permitted by law, KidSync and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app, including but not limited to missed events, scheduling conflicts, or data loss.

12. Account Termination

You may delete your account at any time through the app's settings. We reserve the right to suspend or terminate accounts that violate these Terms. Upon termination, your data will be deleted in accordance with our Privacy Policy. Deleting your account does not automatically cancel an active subscription; you must cancel your subscription separately through your Apple ID settings.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the app or via email. Continued use of the app after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these Terms or your use of KidSync shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.
